Family violence bail and no-contact conditions

Why a preset amount may not apply

Georgia excludes family violence offenses from bail schedules. Judicial guidance calls for a decision based on the circumstances of the case and any necessary conditions. For a warrantless arrest for an act of family violence, the person must be brought before a judicial officer before becoming eligible for bail. Confirm whether that appearance has occurred and what the release order requires.

What bail-restricted means

Crimes involving family violence are on Georgia’s bail-restricted list. The restriction requires secured release when release is allowed; it is not a statement that every family violence defendant is held without any possibility of posting a bail bond.

Before returning home

Check whether the order restricts contact, an address, travel or another activity. If a protective order also exists, read that document too. Have counsel seek clarification or a change from the court instead of treating an invitation home as permission. For retrieving belongings, Forsyth’s civil unit explains that assistance depends on an applicable court order; an order can require a deputy escort.
